On March 24, 2020, the United States Department of Labor (DOL) published a Fact Sheet for Employees, a Fact Sheet for Employers, and a Questions and Answers document regarding the paid leave provisions of House Resolution (HR) 6201.
One of our previous articles (see “Emergency Family and Medical Leave Act Revisions and Emergency Paid Sick Leave—Updated,” in the current issue of the Fiscal Report) stated that the program would be effective April 2, 2020, through December 31, 2020. The final guidance issued by the DOL specifically states that the paid leave provisions are effective on April 1, 2020, and apply to leave taken between April 1, 2020, and December 31, 2020. Paid leave taken prior to April 1, 2020, will not count against the entitlement through this provision.
